Agreement
By accessing prova.media, subscribing to the PROVA newsletter, submitting content to the PROVA Featured Gallery, or using any PROVA service, you agree to these Terms of Service. PROVA is operated by PROVA ARCHIVES LLC ("PROVA," "we," "us"). If you do not agree to these terms, do not use our services.
Newsletter content and editorial disclaimer
PROVA is an editorial publication covering the exotic and collector car market. All newsletter content, including car reviews, market analysis, pricing data, specifications, auction results, and editorial opinions, is provided for informational and entertainment purposes only. PROVA content does not constitute financial advice, investment advice, legal advice, or a recommendation to buy, sell, or hold any vehicle, asset, or security. Market data, pricing ranges, and auction results referenced in PROVA are sourced from public listings and third-party platforms (including Bring a Trailer, RM Sotheby's, and Gooding & Company) and may not reflect current market conditions at the time of reading. Actual vehicle values vary significantly based on condition, mileage, provenance, configuration, and market timing. PROVA ARCHIVES LLC is not a licensed dealer, broker, appraiser, or financial advisor. You should conduct your own due diligence and consult qualified professionals before making any purchase or investment decision based on information in PROVA.
AI-assisted content disclosure
PROVA uses artificial intelligence tools, including large language models, to assist in content research, drafting, and fact-checking. All AI-generated content is reviewed and edited by a human editor before publication. While we employ automated fact-checking against live web sources, we cannot guarantee the accuracy, completeness, or timeliness of any information published. AI systems may produce errors, and market data changes frequently. PROVA ARCHIVES LLC disclaims all liability for inaccuracies in AI-assisted content. Vehicle specifications, production numbers, historical facts, and market data should be independently verified before relying on them for any decision.
AI-generated images
Some visual assets in PROVA may be generated or enhanced using artificial intelligence image generation tools. These images are editorial illustrations and may not accurately represent the exact appearance, specifications, or condition of any specific vehicle. AI-generated images should not be relied upon as representations of any vehicle for sale or any real-world object.
Intellectual property
All content published by PROVA, including but not limited to text, images, audio, design, layout, and branding, is the property of PROVA ARCHIVES LLC and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any PROVA content without prior written permission from PROVA ARCHIVES LLC. Subscribers may share individual issues via email forwarding or social media links for personal, non-commercial purposes.
Gallery submissions and content license
By submitting content (photos, videos) to the PROVA Featured Gallery, you represent and warrant that: (a) you are the original creator of the content or have obtained all necessary rights and permissions to submit it; (b) the content does not infringe on any third party's intellectual property rights, privacy rights, or any applicable law; (c) you are at least 18 years of age. You grant PROVA ARCHIVES LLC a non-exclusive, royalty-free, worldwide, perpetual license to display, reproduce, distribute, and promote your submitted content on prova.media, in PROVA email newsletters, and on PROVA social media accounts (including Instagram, Twitter/X, YouTube, and TikTok). You retain all ownership rights to your original content. PROVA will credit your Instagram handle when featuring your content. No third party is granted any rights to your content through PROVA's use of it. You may request removal of your content at any time by emailing hello@provamag.com, and we will remove it within 30 days. The license granted herein terminates upon removal.
User-submitted content disclaimer
Content submitted to the PROVA Featured Gallery represents the views and creative work of individual submitters, not PROVA ARCHIVES LLC. PROVA does not verify the authenticity, accuracy, or legality of user-submitted content. PROVA reserves the right to reject, remove, or modify any submission at its sole discretion, for any reason, without notice.
Advertising and sponsorship
PROVA may contain sponsored content, advertisements, and affiliate links. Sponsored content is labeled as such. PROVA ARCHIVES LLC may earn commissions from affiliate links. The presence of advertising does not constitute an endorsement of any product, service, or company by PROVA ARCHIVES LLC. We are not responsible for the accuracy of advertiser claims or the quality of advertised products and services.
Email communications
By subscribing to PROVA, you consent to receive email communications including newsletter issues, gallery notifications, and administrative emails. You may unsubscribe at any time. PROVA emails contain tracking technology (open pixels and click tracking) as described in our Privacy Policy. PROVA complies with the CAN-SPAM Act and applicable email marketing regulations.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROVA ARCHIVES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF PROVA SERVICES, RELIANCE ON PROVA CONTENT, OR ANY VEHICLE PURCHASE, SALE, OR INVESTMENT DECISION MADE BASED ON INFORMATION IN PROVA, REGARDLESS OF THE THEORY OF LIABILITY. PROVA'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO PROVA IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
Disclaimer of warranties
PROVA SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. PROVA DOES NOT WARRANT THAT CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE.
Indemnification
You agree to indemnify, defend, and hold harmless PROVA ARCHIVES LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of PROVA services; (b) your gallery submissions; (c) your violation of these terms; or (d) your violation of any third party's rights.
Governing law
These terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of the State of New Mexico.
Modifications
PROVA ARCHIVES LLC reserves the right to modify these terms at any time. Material changes will be communicated via email to active subscribers. Continued use of PROVA services after changes constitutes acceptance of the updated terms.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
